GENERAL TERMS AND CONDITIONS

(“OT COROSAN”)

ACEPTACIÓN GENERAL | GENERAL ACCEPTANCE
ES:
Al acceder, navegar, reservar, realizar un pago o contratar cualquier servicio ofrecido por OT COROSAN, el Cliente reconoce haber leído, entendido y aceptado expresamente los presentes Términos y Condiciones, así como las Políticas de Privacidad, Pago, Cancelación, Reembolso y Seguridad Operativa, las cuales forman parte integral del contrato.

By accessing, browsing, booking, making a payment, or using any service offered by OT COROSAN, the Client expressly acknowledges having read, understood, and accepted these Terms and Conditions, as well as the Privacy, Payment, Cancellation, Refund, and Operational Safety Policies, which form an integral part of this agreement.

1. NATURALEZA DEL SERVICIO | NATURE OF SERVICES
ES:
OT COROSAN opera, organiza, intermedia y comercializa servicios turísticos, incluyendo, de manera enunciativa mas no limitativa: traslados privados, tours, excursiones, actividades recreativas y servicios relacionados.
Los servicios podrán prestarse directamente o a través de proveedores terceros.

OT COROSAN operates, organizes, intermediates, and markets tourism services, including but not limited to private transfers, tours, excursions, recreational activities, and related services.
Services may be provided directly or through third-party suppliers.

2. RESERVAS Y PAGOS | BOOKINGS AND PAYMENTS

ES:
• El Cliente debe proporcionar información veraz, completa y exacta.
• El pago total es obligatorio para confirmar la reserva, salvo indicación escrita en contrario.
• Las tarifas están sujetas a disponibilidad y cambio hasta que el pago sea confirmado.
• OT COROSAN podrá solicitar documentación adicional para verificación de identidad y prevención de fraude.
EN:
• The Client must provide accurate, complete, and truthful information.
• Full payment is required to confirm a booking unless otherwise stated in writing.
• Rates are subject to availability and change until payment is confirmed.
• OT COROSAN may request additional documentation for identity verification and fraud prevention.

3. CANCELACIONES, NO SHOWS Y REEMBOLSOS
CANCELLATIONS, NO SHOWS AND REFUNDS
ES:
• Todas las cancelaciones deben solicitarse por escrito.
• Los reembolsos están sujetos a la política específica del servicio contratado.
• No Show (no presentarse en fecha, hora o punto acordado) no es reembolsable bajo ninguna circunstancia.
• Los servicios no utilizados voluntariamente no son reembolsables.
EN:
• All cancellations must be requested in writing.
• Refunds are subject to the specific policy of the booked service.
• No Shows (failure to appear at the agreed date, time, or location) are non-refundable under any circumstances.
• Unused services are non-refundable.

4. MODIFICACIONES Y CONDICIONES OPERATIVAS
MODIFICATIONS AND OPERATIONAL CONDITIONS
ES:
OT COROSAN podrá modificar, reprogramar o cancelar servicios por razones operativas, climáticas, de seguridad, fuerza mayor o disposiciones gubernamentales.
Las modificaciones solicitadas por el Cliente están sujetas a disponibilidad y pueden generar cargos administrativos.
EN:
OT COROSAN may modify, reschedule, or cancel services due to operational, weather, safety, force majeure, or governmental reasons.
Client-requested modifications are subject to availability and may incur administrative fees.

5. LIMITACIÓN DE RESPONSABILIDAD | LIMITATION OF LIABILITY
ES:
OT COROSAN no será responsable por:
• Eventos fuera de su control
• Actos de terceros
• Información incorrecta proporcionada por el Cliente
• Pérdida, robo o daño de pertenencias personales
EN:
OT COROSAN shall not be liable for:
• Events beyond its control
• Acts of third parties
• Incorrect information provided by the Client
• Loss, theft, or damage to personal belongings.

6. PREVENCIÓN DE FRAUDES Y CONTRACARGOS
FRAUD PREVENTION AND CHARGEBACKS (VISA / MASTERCARD)
ES:
El Cliente reconoce que:
• El pago constituye aceptación expresa del servicio
• La confirmación de reserva, comprobantes de pago, correos, mensajes y estos Términos constituyen prueba legal válida
Cualquier intento de contracargo injustificado será considerado incumplimiento contractual.
OT COROSAN se reserva el derecho de presentar evidencia ante bancos, negar futuros servicios y ejercer acciones legales conforme a la ley mexicana.

The Client acknowledges that:
• Payment constitutes express acceptance of the service
• Booking confirmations, payment receipts, emails, messages, and these Terms constitute valid legal evidence
Any unjustified chargeback attempt will be considered a breach of contract.
OT COROSAN reserves the right to submit evidence to banks, deny future services, and pursue legal action under Mexican law.
7. TARJETAS INTERNACIONALES | INTERNATIONAL CARD PAYMENTS
ES:
Los pagos realizados con tarjetas nacionales o internacionales (Visa, Mastercard, American Express u otras) son transacciones autorizadas, voluntarias y legítimas.
El cargo aparecerá como OT COROSAN / OPERADORA TURÍSTICA COROSAN S. DE R.L. DE C.V.
El Cliente acepta que los procesos de disputa bancaria pueden tardar hasta 90 días, conforme a las reglas del banco emisor.
EN:
Payments made with national or international cards (Visa, Mastercard, American Express or others) are authorized, voluntary, and legitimate transactions.
The charge will appear as OT COROSAN / OPERADORA TURÍSTICA COROSAN S. DE R.L. DE C.V.
The Client acknowledges that bank dispute processes may take up to 90 days, according to issuer rules.

8. LEY APLICABLE Y JURISDICCIÓN | GOVERNING LAW
ES:
Estos Términos se rigen por las leyes de los Estados Unidos Mexicanos.
Cualquier controversia se someterá a los tribunales competentes del Estado de Quintana Roo.
EN:
These Terms are governed by the laws of the United Mexican States.
Any dispute shall be submitted to the competent courts of the State of Quintana Roo.​
PAGOS CON TARJETAS INTERNACIONALES Y CONTRACARGOS
PAYMENTS WITH INTERNATIONAL CARDS AND CHARGEBACKS
ES:
El Cliente reconoce que los pagos realizados con tarjetas nacionales o internacionales (Visa, Mastercard, American Express u otras) son transacciones autorizadas, realizadas de forma voluntaria y con pleno conocimiento del servicio contratado.
EN:
The Client acknowledges that payments made with national or international cards (Visa, Mastercard, American Express, or others) are authorized transactions, carried out voluntarily and with full knowledge of the contracted service.
ES:
El Cliente acepta que:
• El cargo aparecerá en su estado de cuenta como
OT COROSAN / OPERADORA TURÍSTICA COROSAN S. DE R.L. DE C.V.
• El comprobante de pago, la confirmación de la reserva, mensajes, correos electrónicos y los presentes Términos y Condiciones constituyen prueba legal suficiente de la transacción.

The Client agrees that:
• The charge will appear on the bank statement as
OT COROSAN / OPERADORA TURÍSTICA COROSAN S. DE R.L. DE C.V.
• The payment receipt, reservation confirmation, messages, emails, and these Terms and Conditions constitute sufficient legal evidence of the transaction.
ES:
Cualquier intento de contracargo injustificado, incluyendo alegaciones tales como:
• “Servicio no reconocido”
• “Transacción no autorizada”
• “No recibí el servicio”
será considerado incumplimiento contractual.
EN:
Any unjustified chargeback attempt, including claims such as:
• “Service not recognized”
• “Unauthorized transaction”
• “Service not received”
will be considered a breach of contract.
ES:
En caso de disputa, OT COROSAN se reserva el derecho de:
• Presentar evidencia completa ante el banco o procesador de pago
• Compartir confirmaciones, comunicaciones, registros operativos y documentos firmados
• Bloquear futuras reservas del Cliente
• Ejercer acciones legales conforme a la legislación mexicana aplicable

In the event of a dispute, OT COROSAN reserves the right to:
• Submit complete evidence to the bank or payment processor
• Share confirmations, communications, operational records, and signed documents
• Block future reservations from the Client
• Take legal action in accordance with applicable Mexican law
ES:
El Cliente reconoce que los bancos emisores internacionales pueden tardar hasta 90 días en resolver una disputa y acepta someterse a dicho proceso conforme a las reglas de la institución financiera correspondiente.
EN:
The Client acknowledges that international issuing banks may take up to 90 days to resolve a dispute and agrees to submit to such process under the rules of the corresponding financial institution.

ACEPTACIÓN FINAL | FINAL ACCEPTANCE
ES:
La realización de una reserva o pago implica aceptación libre, voluntaria e informada de estos Términos y Condiciones.
EN:
Making a reservation or payment implies free, voluntary, and informed acceptance of these Terms and Conditions.
